DrivenHost respects intellectual property and expects its customers to do the same. We are a hosting provider; we do not create or pre-screen the content our customers publish. This policy explains how we handle complaints.
1. Canadian notice-and-notice
For content hosted in Canada, the Copyright Act requires us to forward a valid notice of claimed infringement to the customer responsible for the content and to retain records, but not to remove the content ourselves. We comply with these obligations. A valid notice must be in writing, state the claimant's name and address, identify the work and the claimant's interest in it, identify the location of the allegedly infringing material, and specify the infringement claimed.
2. Takedown requests
Where content is hosted on infrastructure in the United States, or where a complaint is made under the US Digital Millennium Copyright Act, we follow the DMCA notice-and-takedown procedure: on receipt of a compliant notice we will disable access to the identified material and notify the customer, who may file a counter-notice. If a counter-notice is received we may restore the material after 10 business days unless the claimant informs us that it has filed a court action.
A DMCA notice must include: identification of the copyrighted work; identification of the infringing material and its URL; your contact information; a statement that you have a good-faith belief the use is not authorised; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner; and your physical or electronic signature.
3. European Union
For content hosted on our EU infrastructure we act as a hosting service provider under the EU Digital Services Act and the Copyright in the Digital Single Market Directive. On receipt of a sufficiently precise and substantiated notice identifying the allegedly infringing content and its location, we will act expeditiously to remove or disable access to it, inform the customer with a statement of reasons, and provide both parties with the means to contest the decision. We do not have a general obligation to monitor content and do not do so.
4. Where to send it
Send notices to the support address published on the Contact page with "Copyright" in the subject line. We aim to act on valid notices within two business days.
5. Repeat infringers
Accounts that are the subject of repeated valid complaints will be terminated.
6. Misuse
Knowingly misrepresenting that material is infringing may expose you to liability. We may disregard notices that are incomplete, abusive or plainly unfounded.
